Terms of Service

These Terms govern your access to and use of carbonfreelife.pro and related services (the "Service") provided by CarbonFreeLife ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.

1. Eligibility

By using the Service, you represent and warrant that you are at least 16 years of age or otherwise have the legal capacity to enter into these Terms under applicable law. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. You are responsible for safeguarding your credentials and for all activity under your account.

2. The Service

CarbonFreeLife provides tools to estimate carbon emissions from flights, restaurant meals, food items, and other activities, along with educational information and access to voluntary carbon offset purchases through third-party providers.

Emissions calculations are estimates generated using publicly available emission factors, scientific methodologies, artificial intelligence, and proprietary models. Actual emissions may differ substantially depending on numerous variables.

The Service is intended for informational and educational purposes only and should not be relied upon as scientific, engineering, legal, financial, environmental, regulatory, or tax advice.

3. Carbon Offset Disclaimer

Carbon offsets are issued, verified, retired, and managed by independent third-party project developers and certification bodies. CarbonFreeLife does not own, operate, certify, guarantee, or insure any underlying climate project. We make reasonable efforts to partner with reputable providers but cannot guarantee future project performance, permanence, regulatory treatment, or environmental outcomes.

4. Artificial Intelligence

Certain features use artificial intelligence to analyze menus, estimate emissions, generate recommendations, or improve the user experience. AI-generated results may contain inaccuracies and should be independently verified where accuracy is important.

5. User Content

You retain ownership of content you upload. By uploading content, you grant CarbonFreeLife a worldwide, non-exclusive, royalty-free license to host, process, reproduce, analyze, and display such content solely for operating and improving the Service.

6. Acceptable Use

You agree not to:

  • Reverse engineer, scrape, or overload the Service.
  • Attempt unauthorized access to any part of the Service or its systems.
  • Interfere with the security or integrity of the Service.
  • Use bots, crawlers, or automated tools to overload or disrupt the Service.
  • Upload malware, viruses, or other harmful code.
  • Circumvent payment systems or commit fraud.
  • Misrepresent carbon certificates or offset claims.
  • Impersonate others or misrepresent your offsets.
  • Use the Service for unlawful purposes or to evade legal obligations.
  • Upload unlawful, infringing, or harmful content.

7. Intellectual Property

The Service, including software, algorithms, databases, AI models, trademarks, logos, graphics, and content, remains the exclusive property of CarbonFreeLife or its licensors and is protected by copyright and other laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

8. Third-Party Services

The Service integrates with third-party providers, including but not limited to Stripe, Google, Cloudflare, and carbon offset providers. CarbonFreeLife is not responsible for the availability, content, accuracy, policies, or performance of third-party services.

9. Payments & Offsets

  • Payments are processed by Stripe. Prices are shown in USD unless otherwise stated.
  • Once an offset has been purchased and retired with the underlying project, it is non-refundable.
  • If a charge is incorrect, contact us within 30 days for review.

10. EU Consumers: Digital Delivery & Right of Withdrawal

If you are a consumer resident in the European Union, you normally have a 14-day right of withdrawal for distance contracts. Our offsets, certificates, and subscription features are digital content and services supplied immediately after purchase. By completing checkout you expressly request immediate performance and acknowledge that you lose your right of withdrawal once the offset has been purchased and retired with the underlying project, or once the digital content has been fully supplied. Where a service has only partly been performed, you may withdraw within 14 days and will be charged pro rata for what was supplied. To withdraw, email support@carbonfreelife.pro.

Prices are shown in USD. Where applicable, EU VAT on electronically supplied services is charged and remitted in accordance with the One Stop Shop (OSS) rules; any tax due is shown at checkout.

11. Non-discrimination (EU Regulation 2018/302)

In line with Regulation (EU) 2018/302 on unjustified geo-blocking, we do not block or limit access to the Service based on your nationality, place of residence, or place of establishment, and we do not redirect you to a different country version of the site without your consent — language and region selection is always your choice. The same prices and general conditions of access apply to all customers regardless of country, and we do not refuse or apply different conditions to a payment method because of the country of issue of the card or the location of the payment account, provided the payment is made in a currency we accept and authentication requirements are met. Our services are electronically supplied, so no physical delivery territory applies.

12. Termination

You may close your account at any time from your profile or by contacting support. We may suspend or terminate accounts that violate these Terms, or accounts inactive for more than 24 consecutive months (after a 30-day notice email).

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, CarbonFreeLife will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) USD 100.

15. Indemnification

You agree to defend, indemnify, and hold harmless CarbonFreeLife, its owners, employees, contractors, and affiliates from claims arising from your misuse of the Service, violation of these Terms, or infringement of any rights.

16. Force Majeure

CarbonFreeLife is not liable for delays or failures resulting from circumstances beyond our reasonable control, including natural disasters, internet outages, cyberattacks, labor disputes, governmental actions, or failures of third-party infrastructure.

17. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Mandatory consumer rights in your country of residence are not affected.

18. Dispute Resolution

Before filing legal proceedings, both parties agree to attempt to resolve disputes informally by contacting support@carbonfreelife.pro.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

20. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CarbonFreeLife regarding the Service.

21. Assignment

CarbonFreeLife may assign these Terms in connection with a merger, acquisition, sale of assets, or corporate reorganization.

22. Electronic Communications

By creating an account, you consent to receive communications electronically.

23. Availability

We do not guarantee uninterrupted or error-free availability of the Service. Maintenance, updates, outages, and third-party failures may temporarily affect availability.

24. Changes

We may update these Terms. Continued use of the Service after changes constitutes acceptance. Material changes will be announced on this page.
